b) Higher education institutions shall be responsible for self-assurance about funding from financial sources that are legal in order to carry out refresher training for enhancement of competency of lecturers and administrators; attraction for scientists and doctorate degree holders; implementation of activities within the scope of the proposal according to the functions and tasks of the units. The payment details and amounts shall comply with internal expenditure regulations of units;

Chapter II

SPECIFIC PROVISIONS

Article 3. Funding for offshore full-time programs (doctoral and master degree courses)

1. Tuition fees and expenses regarding tuition fees: Make payment according to the contract signed between the Ministry of Education and Training of Vietnam and the overseas training institution or according to notification of the overseas training institution in admission notice (US dollar or the currency of the host country). The maximum fee shall be $25.000/learner/school year or equivalent to the currency of the host country. The amount in excess of $25.000/learner/year shall be paid by the learner or the higher education institution that appoints the lecturers to study courses according to internal expenditure regulations of unit.

In special cases, if it is necessary to attract and develop the source of lecturers from excellent graduates and young scientists who meet the conditions as prescribed in the Government’s Decree No. 140/2017/ND-CP dated December 5, 2017 on the policy on attraction and development of sources of officials from excellent graduates and young scientists, the Minister of Education and Training shall consider, make decisions on a case-by-case basis and make payment according to the tuition fees prescribed by the training institution and within the scope of assigned estimates.

2. Passport and visa fees: Make payment according to regulations of the State of Vietnam on passport fees and actual invoices for visa fees of the countries where the learners are sent to.

3. Subsistence allowances:

a) Subsistence allowances for learners shall comply with regulations in the Appendix of this Circular. Subsistence allowances shall be granted according to the actual period of study (from the date of admission to the date of completion of the course without exceeding the time stated in the decision on appointment to training courses of the Minister of Education and Training of Vietnam);

b) The payment of subsistence allowances shall be made every three months or every six months in order to ensure that it does not influence the learners' study and research.

a) Compulsory health insurance: Make payment according to regulations of the host country (admission notice of the overseas training institution). It shall be paid in US dollar or the currency of the host country and at most $1.000/learner/school year;

b) The amount of excess of $1.000/learner/school year shall be paid by the learner.

5. Round trip flight ticket (Economy class):

a) Provide round trip flight tickets for the learners (from Vietnam to the place of study and vice versa) in the entire period of training, unless the flight ticket is paid by the other/foreign party;

b) Make payment according to applicable regulations on regimes and norms of state budget expenditure.

6. Travel allowances that reimburse airport charges and fees for rental of vehicles from the airport to accommodation and vice versa shall be granted once with fixed funding of $100/person for the entire period of training.

7. Other expenses incurred in the process of training:

a) Expenses for transfer and receipt of money through banks regarding overseas training courses (if any): according to the regulations of the banks in the host country and in Vietnam, if there is any expense incurred for transfer or receipt of money through the banks, the state budget shall cover this expense according to the actual expense incurred;

b) Expenses for support for handling of risks and force majeure events that happen to learners who are sent to training courses: In case of death, the state budget shall cover the full fees for transportation of corpses or ashes of learners from foreign countries to Vietnam or cover the part of freight that is not covered by insurance;

Article 4. Funding for onshore full-time programs (doctoral degree courses)

1. Tuition fees paid for higher education institutions of Vietnam selected by the Ministry of Education and Training to participate in the training tasks of the proposal: Make payment according to regulations of the higher education institutions. The maximum fee does not exceed the tuition fee specified in the Government's Decree No. 81/2021/ND-CP dated August 27, 2021 on tuition fees of education institutions affiliated to national education program and collection, management thereof; policies on tuition fee exemption, reduction, and financing for learning fees; service fees in education and training sectors.

2. Funding for research and study shall include:

a) Complete dissertation; attend seminars and conferences in Vietnam, as follows:

- Medicine and Pharmacy, Physical Education, Sports and Arts: 20 million VND/learner/year;

- Sciences, engineering, technology, agriculture forestry and fisheries: 18 million VND/learner/year;

- Social sciences, economy, law; hotel, tourism and other industries: 13 million VND/learner/year;

The period of support: no more than 4 years.

b) Publish international scientific journals; attend international conferences and seminars; participate in short-term internships in foreign countries:

- The learners with the results of learning that meet the conditions under Circular No. 25/2021/TT-BGDĐT shall be invited to attend international conferences, seminars or allowed to participate on short-term internships abroad. The state budget shall cover travel and subsistence allowances (no more than 01 time in the entire period of training) according to the regulations of Circular No. 102/2012/TT-BTC dated June 21, 2012 of the Ministry of Finance on the regime of working-trip allowances for state officials and employees who travel abroad on short working missions funded by the state budget In case, the learners are supported funding for participation in international seminars, conferences or short-term internships by other organizations, the state budget will not support these expenses.

The higher education institutions that appoint lecturers to study shall be responsible for creation of standards, criteria and regulations on support for learners who meet the conditions to receive support according to the above contents and publicly notification before implementation according to regulations of Circular No. 25/2021/TT-BGDĐT of the Ministry of Education and Training and this Circular.

In addition to support from the state budget, the higher education institutions that appoint lecturers to study shall mobilize other legal contributions to support funding for learning and research according to internal expenditure regulations of units.

Article 5. Doctoral level training association program support.

The doctoral level training association programs shall comply with regulations of Circular No. 25/2021/TT-BGDDT. Payment details and amounts:

1.  Full-time onshore learners: Comply with regulations of Article 4 of this Circular.

2. Full-time offshore learners (no more than 02 years): Comply with regulations of Article 3 of this Circular.

Chapter III

FUNDING ESTIMATION, ALLOCATION, MANAGEMENT AND SETTLEMENT

1. Ministry of Education and Training;

a) Annually, according to the objectives and tasks of the proposal, the Ministry of Education and Training shall instruct the management agencies of higher education institutions (public institutions) and other non-public institutions that appoint lecturers to attend training courses to report on the implementation of the proposal, develop the plan for implementation of the proposal, especially the quantity, method and level of training and at the same time make cost estimates for the implementation of the proposal according to funding sources (state budget and other funding sources) under the payment details and amounts specified in this Circular;

b) According to reports, plans and proposal for allocation of cost estimates of the Ministries, central and local authorities and non-public higher education institutions, guidance on making of annual budget estimates of the Ministry of Finance; The Ministry of Education and Training shall be responsible for review and submission of the budget estimates for the implementation of the proposal to the Ministry of Finance for report to the competent authorities for approval according to regulations. In which:

- Offshore full-time programs; the period of overseas training according to training association programs and the funding for training of learners of non-public higher education institutions: Make cost estimates for implementation of the proposal and consolidate the estimates in the annual budget estimate of the Ministry of Education and Training for payment for overseas higher education institutions and learners according to regulations;

- Onshore full-time programs, the period of domestic training according to training association programs: Make cost estimates for implementation of the proposal and consolidate the estimates in the annual budget estimates of the Ministries, central and local authorities for payment for higher education institutions and learners in Vietnam according to regulations;

2. Ministries, central and local authorities:

According to the objectives of proposal; guidance of the Ministry of Education and Training on making of reports and cost estimates for the implementation of the proposal; the results of the assessment of the implementation of the tasks of proposal; the Ministries, central and local authorities shall instruct higher education institutions affiliated to the Ministries, central and local authorities to report on the implementation of the proposal, develop the plans for implementation of the proposal, summarize and submit to the Ministry of Education and Training according to regulations in Clause 1 of this Article; at the same time submit to the Ministries and central authorities (training institutions under the management of ministries and agencies under the management of the central authorities), submit to the direct management agencies (higher education institutions under the management of local authorities) for summarization in the budget estimate of the plan year within the hierarchy of state budget management, submit to the financial agencies at the same level for consideration, summarization and report to the competent authorities for approval according to regulations.

3. Non-public higher education institutions:

According to the objectives of proposal; guidance of the Ministry of Education and Training on making of reports and cost estimates for the implementation of the proposal; the results of the assessment of the implementation of the tasks of proposal and the plans for implementation of the proposal; the non-public higher education institutions shall make reports and cost estimates for appointing lecturers who attend training courses under the proposal, summarize and submit to the Ministry of Education and Training as prescribed in Clause 1 of this Article.

1. According to the cost estimates for implementation of the proposal assigned by the competent authorities; the plans for implementation of proposal, training targets that are approved and actual list of learners; the Ministries, central and local authorities shall allocate and assign cost estimates to higher education institutions affiliated to the Ministries, central and local authorities that appoint lecturers to attend training courses in order to pay for training institutions and learners in Vietnam according to regulations on onshore full-time programs, the period of training in Vietnam of  training association program, submit to financial agencies at the same level for inspection in accordance with the Law on State Budget; and submit to the Ministry of Education and Training for consideration, summarization.

2. The funding for training according to offshore full-time programs; the period of overseas training according to training association program and the funding for training of learners of non-public higher education institutions who attend the proposal shall be allocated and assigned in the annual budget estimate of the Ministry of Education and Training for payment for overseas higher education institutions that receive learners according to the proposal and overseas learners;

3. In 2022, the Ministry of Education and Training, ministries, central and local authorities shall proactively allocate funding in the assigned estimates to perform the tasks of the proposal according to the guidance in this Circular.

Article 8. Principles of management and settlement of funding from state budget

1. Regulations on control of payment of support funding for learners at the State Treasury:

a) Dossiers and procedures for control of payment of the funding for domestic and overseas training through the State Treasury: Comply with regulations of Decree No. 11/2020/ND-CP dated January 20, 2020 of the Government on administrative procedures for State Treasury operations (hereinafter referred to as “Decree No. 11/2020/ND-CP").

b) Regulations on control and payment of the funding through the State Treasury: Comply with regulations of Circular No. 62/2020/TT-BTC dated June 22, 2020 of the Ministry of Finance on guidance on control and payment of frequent expenditures from the state budget through the State Treasury and other applicable regulations. In which the expenditure control records for the funding for overseas training shall be made as follows:

The budget using-unit shall make document on request for disbursement of estimated fund according to the total amount in the list of transfer of the funding for training of overseas learners under each country/school, each type of foreign currency or the document on request for disbursement of estimated fund for each learner and submit to the State Treasury enclosed with the documents specified in Article 7 of Decree No. 11/2020/ND-CP.

Dossiers on payment of the funding for training of learners shall contain the following contents: full name of learner; name of the country where the learner is studying; payment details; the amount in foreign currency for each learner; account name of beneficiary (name of the foreign training institution or an individual); account number of the beneficiary; swift code of the bank of the beneficiary or the full name and address of the bank of the beneficiary; intermediary bank (if any); transfer fee and others (if any).

The State Treasury shall control and carry out procedures to request the bank to transfer money from the payment account of the State Treasury to each beneficiary according to the assigned estimates and the dossiers sent by the units.

Subsistence allowances and health insurance: the learners who attend overseas training programs shall receive travel allowances and subsistence allowances (a maximum period of 3 months) before admission.

2. The support funding for learners according to the approval decision of the Minister of Education and Training shall be calculated from the dates on which these learners formally enter their courses at receiving institutions or from the dates on which these approval decisions have influence upon doctoral learners; the maximum time limits of funding to doctoral learners and master’s learner shall be 04 years (48 months) and 02 years (24 months), respectively During the period of suspension of study and research, the learners are not entitled to receive the funding of proposal.

3. The funding from state budget according to decision of the Minister of Education and Training shall cease being offered to learners committing breach of laws to the extent of being prosecuted for penal liability, imprisoned or expelled from school due to any breach of regulations of receiving institutions during their study or research period.

4. The learners shall repay all funding for training in case they fail to fulfill their responsibilities specified in Clause 2, Article 6 of Circular No. 25/2021/TT-BGDDT. The repayment shall comply with regulations of the Government’s Decree No. 143/2013/ND-CP dated October 24, 2013 on repayment of scholarships and funding for training of learners who are not officials, public employees, the Government’s Decree No. 101/2017/ND-CP dated September 01, 2017 on training and refresher training of cadres, public officials and public employees for learners who are officials, public employees and applicable regulations.

5. The management and use of the funding for payment for non-public institutions shall comply with regulations of applicable law on the state budget and this Circular. Make payment according to the contract within the scope of estimates approved by the competent authorities.

6. The Ministry of Education and Training shall take charge and cooperate with relevant agencies in supervision and inspection of the management of the funding for the implementation of the proposal, evaluate and summarize the results of the implementation of the proposal in accordance with regulations.

7. The funding for the implementation of the proposal shall be managed, used and settled in conformity with the nature of the funding sources and the corresponding expenditure items of the state budget index, consolidated in the annual reports on settlement of the units that are submitted to the superior management agency for approval and the financial agency for appraisal of the final settlement in accordance with the law on state budget.

Chapter IV

Article 9. Implementation

1. This Circular comes into force as of July 20, 2022.

2. The learners who are studying under the Scheme on doctoral training for university and college lecturers during 2010-2020 according to Decision No. 911/QD-TTg dated June 17, 2010 of the Prime Minister, the Scheme on overseas training of officials with the state budget for the period of 2013 - 2020 according to the Prime Minister's Decision No. 599/QD-TTg dated April 17, 2013 shall continue to be entitled to funding according to regulations of Joint Circular No. 130/2013/TTLT-BTC-BGDDT dated September 19, 2013 of the Ministry of Finance, the Ministry of Education and Training guiding the financial regime for implementation of Decision No. 911/ QD-TTg; Joint Circular No. 05/2015/TTLT-BTC-BGDDT dated March 10, 2015 of the Ministry of Finance and the Ministry of Education and Training guiding enrollment and financial regime for implementation of Decision No. 599/QD-TTg until the completion of the training programs according to the approval decision of the Ministry of Education and Training.

3. In the cases where any of the legislative documents referred to in this Circular is amended or replaced, the newest one shall apply.

4. The difficulties that arise during the implementation must be reported to the Ministry of Finance for research and consideration./.
