Article 3. Forms of administrative penalties

1. Main forms of penalty:

a) Warnings;

b) Fine.

2. Additional penalties:

a) Suspension of Certificate of eligibility for betting operation, Certificate of eligibility for casino operation, Certificate of eligibility for operation of prize-winning electronic games for foreigners (hereinafter referred to as “Certificate of eligibility”);

b) Confiscation of exhibits, instruments of administrative violations.

Depending on the nature and seriousness of the violations, offenders in betting and prize-winning game operations shall be met with one or multiple remedial measures below according to Chapter II hereof:

1. Mandated submission of Certificate of eligibility that has been fabricated or modified.

2. Mandated disposal or re-export of game machines, game tables, prize-winning game equipment, or tokens which exceed the regulated quantity or do not match the form, type of prize-winning game.

3. Mandated restoration of casino venues, prize-winning game business facilities (hereinafter referred to as “business facilities”) satisfactory to requirements and location permitted by the authorities that grant permission for operation.

4. Mandated adequate monitoring and management of individuals entering and exiting business facilities either by logbook or electronic card.

5. Mandated establishment of internal control and appointment of personnel to manage and coordinate business facilities as per the law.

6. Mandated payout for bettors in accordance with game rules, betting rules.

7. Mandated revocation of payout confirmation which was issued to the wrong recipients or contained incorrect payout value.

8. Mandated removal of contents and advertisements which does not adhere to the law.

10. Mandated revision to publicized information, submission of reports, provision of adequate information and data.

11. Mandated submission of revenues generated by administrative violations.

Article 5. Fine, entitlement to impose fine, and rules of imposing administrative penalties

1. The maximum fine for administrative violations in betting and prize-winning game is 200.000.000 VND for organization offenders and 100.000.000 VND for individual offenders.

2. Fine, entitlement to impose fine, and entitlement to confiscate exhibits of administrative violations of each title in regard to violations hereunder apply to organization offenders, except for Article 13, Article 31, and Article 45 hereof which only apply to individual offenders. Fine, entitlement to impose fine of each title in regard to individual offender shall equal half of those in regard to organization offender for the same administrative violations hereunder.

Article 6. Prescriptive period, procedures for imposing penalties and carrying out administrative penalties in betting and prize-winning game operations

1. Prescriptive period for administrative penalties in betting and prize-winning game operations is 1 year.

2. The starting point of prescriptive period for administrative penalties in betting and prize-winning game operations is provided for as follows:

a) In case of an ongoing administrative violation, prescriptive period shall start from the date on which a competent individual, in the performance of his/her duty, discovers the violation;

3. The violation end date serving calculation of prescriptive period of violations under Chapter II hereof is provided for as follows:

a) With respect to violations relating to application for issuance of Certificate of eligibility under Article 8, Article 25, and Article 39 hereof, the violation end date shall be the date on which the application is submitted to Ministry of Finance;

b) With respect to erasure or modification of the Certificate of eligibility under Clause 1 Article, Clause 1 Article 26, and Clause 1 Article 40 hereof, the prescriptive period starts from the date on which the erasure or modification takes place; if the erasure or modification date cannot be identified, the violation end date shall be the date on which the Certificate of eligibility is found to be erased or modified;

c) With respect to failure to submit game rules or betting rules to the authorities, racing rules to supervisory council of the race in a timely manner according to Clause 1 Article 14, Clause 1 Article 29, and Clause 1 Article 43 hereof, the violation end date shall be the date on which game rules or betting rules are sent to the authorities, racing rules are sent to supervisory council of the race;

d) With respect to failure to inform authorities about change of individuals managing, coordinating business facilities in a timely manner according to Point b Clause 1 Article 34 and Point b Clause 1 Article 48 hereof, the violation end date shall be the date on which notice on change of individuals managing, coordinating business facilities is sent to the authorities;

dd) With respect to violations regarding information provision under Article 22, Article 37, and Article 51 hereof, the violation end date shall be the date on which written information disclosure is submitted;

e) With respect to violations regarding advertisements according to Clause 3 Article 23, Clause 3 Article 36, and Clause 3 Article 50 hereof, the violation end date shall be the date on which the violating advertisements are removed.

g) With respect to violations regarding reports according to Article 24, Article 38, and Article 52 hereof, the violation end date shall be date on which reports are submitted, information and data are provided to the authorities in an adequate manner as per the law.

4. Ongoing administrative violations, concluded administrative violations, procedures for imposing penalties, carrying out penalties, implementing penalty decisions, and enforcing implementation of penalty decisions in betting and prize-winning game operations shall conform to the Law on Administrative Penalties and guiding documents.

1. Upon discovering violations under Clause 2 Article 8, Clause 2 Article 25, Clause 2 Article 39, and Clause 2 Article 56 hereof, competent individuals accepting the case must transfer the case file to competent criminal proceeding agencies for criminal prosecution in accordance with Clause 1, Clause 2, and Clause 4 Article 62 of the Law on Administrative Penalties and amending documents (if any).

2. In case criminal proceeding agencies issue any of the decision to refuse criminal prosecution as per criminal laws and return the case file to the competent individuals who previously sent the case file, the case file shall be sent to competent individuals according to Clause 3 Article 62, Article 63 of the Law on Administrative penalties and amending documents (if any) in order to impose administrative penalties in accordance with this Decree.

Chapter II

ADMINISTRATIVE VIOLATIONS, PENALTIES, FINE, AND REMEDIAL MEASURES

Section 1. VIOLATIONS REGARDING BETTING OPERATIONS

Article 8. Violations regarding application for issuance of Certificate of eligibility for betting operation

1. A fine ranging from 40.000.000 VND to 60.000.000 VND is imposed on erasing or modifying documents in the application for issuance, re-issuance, revisions, extension of Certificate of eligibility for betting operation. Fine imposed on erasing, modifying, or otherwise altering details of criminal records in applications for issuance, extension of Certificate of eligibility for betting operation shall conform to Clause 2 Article 47 of Decree No. 82/2020/ND-CP dated July 15, 2020 of the Government and amending documents (if any).

2. A fine ranging from 80.000.000 VND to 100.000.000 VND is imposed on producing, verifying fabricated documents or containing incorrect information or concealing the truth in application for issuance, re-issuance, revision, extension of Certificate of eligibility for betting operation. Fine imposed on using falsified criminal records in applications for issuance, extension of Certificate of eligibility for betting operation shall conform to Point r Clause 2 Article 81 of Decree No. 82/2020/ND-CP and guiding documents (if any).

a) Engaging in betting operation without obtaining Certificate of eligibility for betting operation;

b) Engaging in betting operation during suspension or revocation of the Certificate of eligibility for betting operation.

4. Additional penalties:

2. A fine ranging from 180.000.000 VND to 200.000.000 VND is imposed on:

a) Engaging in betting operation in a manner that exceeds the scope of business permitted by the authority;

a) Operating forms of bet that contradicts regulations and law on betting operation;

b) Operating bets in a manner that contradicts regulations and law on betting operation.

b) Suspension of Certificate of eligibility for betting operation for 6 to 12 months for violations under Clause 2 of this Article.

3. A fine ranging from 90.000.000 VND to 100.000.000 VND is imposed on:

a) Fabricating bet tickets in order to receive prize;

Article 7. Violations regarding frequency of bets and time of bet acceptance

1. A fine ranging from 90.000.000 VND to 100.000.000 VND is imposed on violating time of bet acceptance.

2. A fine ranging from 180.000.000 VND to 200.000.000 VND is imposed on violating frequency of bets.

a) Mandated termination of contracts signed with individuals and organizations which are not eligible for acting as betting ticket sale agencies as per the law.

b) Mandated submission of illegal revenues generated by the violations under Clause 1 of this Article.

Article 20. Violations regarding payout, payout rate, and payout methods

1. A fine ranging from 20.000.000 VND to 30.000.000 VND is imposed on failing to award winning betters with payout in a timely manner.

2. A fine ranging from 180.000.000 VND to 200.000.000 VND is imposed on:

a) Intentionally publicizing winning results other than those verified in writing by the supervisory council of the race or conclusion of head referee in international football matches or those publicized by event organizers;

c) Develop expected payout rate 65% lower than the minimum value based on ticket sales in each bet;

d) Issuing payout confirmation to the wrong recipients or containing incorrect payout value.

Article 21. Violations regarding organizing horse racing, dog racing

1. A fine ranging from 90.000.000 VND to 100.000.000 VND is imposed on violations relating to racehorses, racing dogs, jockeys, and referees.

2. A fine ranging from 40.000.000 VND to 60.000.000 VND is imposed on violations regarding discount, sale promotion.

a) Mandated destruction or re-export of game machines, game tables exceeding the limit or not fitting the types, modes of prize-winning games for violations under Clause 1 and Clause 2 of this Article;

b) Mandated submission of illegal revenues generated by the violations under Clause 1 and Clause 2 of this Article.

Article 29.Violations regarding development and disclosure of game rules

2. A fine ranging from 180.000.000 VND to 200.000.000 VND is imposed on:

Article 31. Violations regarding obligations of players

1. A fine ranging from 40.000.000 VND to 50.000.000 VND is imposed on using tokens that fail to meet technical requirements.

2. A fine ranging from 60.000.000 VND to 70.000.000 VND is imposed on failing to register tokens to the authority.

3. A fine ranging from 120.000.000 VND to VND 130.000.000 VND is imposed on using tokens of other enterprises or tokens not registered to the authority.

Article 33. Violations regarding management of game machines, game tables, and game equipment

2. A fine ranging from 90.000.000 VND to 100.000.000 VND is imposed on importing backup equipment or managing backup equipment in a manner that does not comply with the law.

3. A fine ranging from 180.000.000 VND to 200.000.000 VND is imposed on:

a) Running game machines or game tables without meeting all requirements of the law;

b) Failing to possess documents of manufacturers, providers of game machines, game tables, or independent inspecting organizations to prove that the game machines, game tables have met all requirements of the law.

b) Failing to inform competent authority when changing individuals managing, coordinating business facilities according to the list registered under the application for certificate of eligibility for casino operation.

2. A fine ranging from 90.000.000 VND to 100.000.000 VND is imposed on:

2. A fine ranging from 40.000.000 VND to 60.000.000 VND is imposed on violations regarding discount, sale promotion.

3. A fine ranging from 60.000.000 VND to 80.000.000 VND is imposed on:

a) Engaging in casino operation without obtaining license to engage in casino operation from competent authorities;

A fine ranging from 80.000.000 VND to 100.000.000 VND is imposed on producing, verifying fabricated documents or containing incorrect information or concealing the truth in application for issuance, re-issuance, revision, extension of Certificate of eligibility for electronic prize-winning game operation.

3. A fine ranging from 180.000.000 VND to 200.000.000 VND is imposed on:

a) Running electronic prize-winning game operation without obtaining license to do so from competent authority;

b) Running electronic prize-winning game operation during the period in which certificate of eligibility for electronic prize-winning game operation is suspended or revoked.

a) Suspension of certificate of eligibility for electronic prize-winning game operation for 3 to 6 months for violations under Point a Clause 1 of this Article.

2. A fine ranging from 180.000.000 VND to 200.000.000 VND is imposed on running more electronic prize-winning game machines than the licensed amount.

Suspension of certificate of eligibility for electronic prize-winning game operation for 6 to 12 months for violations under Clause 1 and Clause 2 of this Article.

4. Remedial measures:

a) Mandated destruction or re-export of electronic prize-winning game machines that exceed the licensed amount or do not match the licensed type or do not offer the licensed form of electronic prize-winning games for violations under Clause 1 and Clause 2 of this Article.

Article 44. Violations regarding monitor and management of individuals allowed to play, enter, exit business facilities

a) Mandated keeping of logbook or issuance of electronic cards for adequate monitoring and management of individuals allowed to enter, exit business facilities for violations under Clause 1 and Clause 2 of this Article;

b) Mandated submission of illegal revenues generated by violations under Clause 2 of this Article.

2. A fine ranging from 60.000.000 VND to 70.000.000 VND is imposed on importing backup machines or devices, managing backup machines or devices in a manner that does not comply with the law.

3. A fine ranging from 180.000.000 VND to 200.000.000 VND is imposed on:

a) Running electronic prize-winning game machines that do not meet requirements and technical standards;

b) Failing to obtain documents issued by game machine manufacturers or independent inspecting organizations to prove that electronic prize-winning game machines have satisfied all conditions.

b) Failing to inform competent authority when changing individuals managing, coordinating business facilities according to the list registered under the application for certificate of eligibility for electronic prize-winning game operation.

Mandated establishment of internal control department and appointment of eligible individuals managing, coordinating business facilities for violations under Point b Clause 2 and Clause 3 of this Article.

Article 49. Violations regarding payout and payout confirmation

1. A fine ranging from 10.000.000 VND to 20.000.000 VND is imposed on intentionally delaying payout without justifiable reasons.

1. A fine ranging from 40.000.000 VND to 60.000.000 VND is imposed on failing to update know-your-customer information in accordance with Article 8, Article 10 of the Law on Anti-Money Laundering and Article 34 of the Law on Anti-Terrorism.

2. A fine ranging from 60.000.000 VND to 100.000.000 VND is imposed on failing to adopt customer due diligence solutions or enhanced due diligence solutions in accordance with Clauses 2, 3, and 4 Article 12 of the Law on Anti-Money Laundering and Article 34 of the Law on Anti-Terrorism.

a) Organizing or facilitating money laundering without being liable to criminal prosecution;

Article 60. Preparation of offence notice

1. Upon discovering administrative violations in betting and prize-winning operations, competent individuals mentioned under Articles 57, 58, and 59 hereof must promptly produce administrative offence notice.

2. Administrative offence notice must be produced with appropriate contents, formats, and procedures in accordance with regulations on administrative penalties and serve as the basis for issuing decisions imposing penalties for administrative violations.

3. In addition to titles under Articles 57, 58, and 59 hereof, competent individuals entitled to impose administrative penalties and working in other agencies prescribed by regulations and law on administrative penalties are also entitled to produce administrative offence notice upon discovering administrative violations in betting and prize-winning game operations within their functions and tasks.

Article 61. Complaints and accusations

Complaints, accusations and resolution thereof with respect to decisions imposing administrative penalties in betting and prize-winning game operations shall conform to regulations and law on complaints and accusations.

Article 63. Transition clauses

1. With respect to violations that occurred before the effective date hereof and are discovered or subject to decisions imposing penalties after the effective date hereof, adopt this Decree if legal liabilities are not mandated by this Decree or are mandated to a lesser extent by this Decree.

2. In case organizations, individuals met with decisions imposing administrative penalties in betting and prize-winning game operations that have been issued or implemented before the effective date hereof file complaints, adopt Decree No. 06/2017/ND-CP dated January 24, 2017 of the Government, Decree No. 03/2017/ND-CP dated January 16, 2017 of the Government, and Decree No. 86/2013/ND-CP dated July 29, 2013 of the Government to resolve.
