OF THE MINISTER OF SCIENCE AND TECHNOLOGY NO.05/2005/QD-BKHCN DATED MAY 11, 2005 ON AMENDING, SUPPLEMENTING THE DECISION NO.28/2004/QD-BKHCN DATED 01/10/2004 ON METHODS OF DETERMINING THE LOCALIZATION RATES OF AUTOMOBILES

THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to the 1999 Ordinance on Goods Quality;
Pursuant to the Decree No.54/2003/ND-CP dated 19/5/2003 of the Government providing for function, duties, authorities of organizational structure of the Ministry of Science and Technology and the Decree No.28/2004/ND-CP dated 16/01/2004 of the Government amending, supplementing a number of Articles of the Decree No.54/2003/ND-CP dated 19/5/2003
Pursuant to the Decision No.175/2002/QD-TTg dated 03/12/2002 of the Prime Minister on approving the strategy on development of Vietnams’ automobile industry till 2010 and the vision till 2020;
Pursuant to Directive of the Prime Minister in the Notification No.82/TB-VPCP dated 16/6/2003, Official Dispatch No.4659/VPCP-KG dated 24/9/2003, the Notification No.63/TB-VPCP dated 02/4/2004 and Official Dispatch No.2943/VPCP-KG dated 11/6/2004 of the Government Office;
Pursuant to the Decision No.177/2004/QD-TTg dated 05/10/2004 of the Prime Minister on approving the planning on development of Vietnams automobile industry till 2010 and the vision till 2020;
At the proposal of General Director of Directorate For Standards, Metrology and Quality and Director of Department of Legal,

DECIDES:

Article 1. Amending, supplementing Clause 4 Article 5 of Decision No.28/2004/QD-BKHCN dated 01/10/2004 of the Minister of Science and Technology on methods of determining the localization rates for automobiles as follows:

"4. The automotive components directly imported by enterprises or purchased from importing commercial enterprises shall not be calculated as localized one.

Discrete levels of imported components are specified as follows:

- Car chassis: Already connected to each other and not be powder coated yet. For the chassis of a length of 3.7 m or more, are allowed powder coating before being imported.

- Engine: Completed and may be linked to the clutch and gearbox.

- Transmission system: whether or not fitted yet with brakes.

- Electrical systems, lighting and amenities: The discrete systems of electrical wiring, panels, lighting and amenities in the cars.

The Annex 5, 6, 7, 8 issuing together with this Decision illustrates the structure of discrete level of components for cars of all types".

Article 2. This Decision takes effect 15 days after the date of its publication in Official Gazettes.

Article 3. General Director of the Directorate For Standards, Metrology and Quality, the Director of the Department for Technological Appraisal, Evaluation and Expertise, Director of Department of Science and Technology of Economic-Technical Branches, Director of Legal Department, Director of Ministry’s Office and relative organizations, individuals are responsible for the implementation of this Decision.
